1. Acceptance of Terms
By accessing or using the McGregor Sceptre website, portal, or any of our services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use our Services. These Terms apply to all users, including worker applicants, employers, and visitors.
2. Description of Services
McGregor Sceptre LLC provides seasonal staffing services, including:
- Sourcing, screening, and matching H-2A and H-2B visa workers with U.S. employers.
- An online portal for employers to post job orders and review candidates.
- An online application system for workers seeking seasonal employment.
- Assistance with immigration compliance documentation.
We act as an intermediary staffing agency. We are not an immigration law firm and do not provide legal advice. Employers remain the petitioning entity for all visa applications.
3. User Accounts
- You must provide accurate, current, and complete information during registration.
- You are responsible for maintaining the confidentiality of your account credentials.
- You must notify us immediately of any unauthorized use of your account.
- We reserve the right to suspend or terminate accounts that violate these Terms or contain fraudulent information.
4. Employer Obligations
Employers using our Services agree to:
- Provide accurate job descriptions, wage rates, and working conditions that comply with all applicable federal and state laws.
- Meet all DOL and USCIS requirements as the petitioning employer for H-2 visas.
- Not discriminate against workers on the basis of race, color, national origin, sex, religion, age, or disability.
- Pay all agreed-upon staffing fees and worker wages in a timely manner.
- Provide safe working conditions in compliance with OSHA and applicable regulations.
5. Worker Applicant Obligations
Worker applicants agree to:
- Provide truthful and accurate personal information, work history, and documentation.
- Not misrepresent qualifications, identity, or eligibility.
- Respond to communications in a timely manner during the placement process.
- Comply with all terms of employment and visa conditions upon placement.
6. Fees & Payment
- Staffing service fees are outlined in individual employer agreements.
- Workers are never charged placement fees. McGregor Sceptre does not charge workers for job placement services, in compliance with federal regulations.
- Payment terms, invoicing schedules, and refund policies are governed by the applicable employer service agreement.
7. Portal Access & Resume Unlock Credits
Employers who purchase a portal subscription receive access to browse candidate profiles on our platform. The following terms govern portal usage:
- Upon payment, employers receive access to browse all available candidate profile cards, which display general information including the candidate’s name, job title, industry category, experience level, and bio summary.
- Candidate contact information (email, phone) and resume access (view and download) are gated behind a limited number of profile unlock credits.
- Each subscription includes ten (10) profile unlock credits. Each unique candidate profile unlocked consumes one (1) credit.
- Once a candidate profile has been unlocked, the employer may view and download that candidate’s resume and contact information an unlimited number of times at no additional cost.
- Unlock credits are non-transferable and are tied to the employer’s account. They do not expire as long as the subscription remains active.
- Additional unlock credits may be purchased or granted at McGregor Sceptre’s discretion. Contact info@mcgregorsceptre.com for inquiries.
- McGregor Sceptre reserves the right to modify the number of included unlock credits for future subscription purchases. Existing subscriptions will honor the terms in effect at the time of purchase.
- Employers may not share unlocked candidate information with third parties without prior written consent from McGregor Sceptre.
8. Intellectual Property
All content on our websites and portal — including text, graphics, logos, software, and design — is the property of McGregor Sceptre LLC or its licensors and is protected by U.S. copyright and trademark laws. You may not reproduce, distribute, or create derivative works without prior written consent.
9. Prohibited Conduct
You agree not to:
- Use the Services for any unlawful purpose or in violation of immigration laws.
- Submit false, misleading, or fraudulent information.
- Attempt to gain unauthorized access to our systems, accounts, or data.
- Interfere with the proper functioning of the platform (e.g., introducing malware, scraping data).
- Harass, threaten, or discriminate against any user.
- Use candidate information obtained through our platform for purposes unrelated to the staffing engagement.
10. Limitation of Liability
To the fullest extent permitted by law:
- McGregor Sceptre provides its Services "as is" and "as available" without warranties of any kind.
- We are not liable for indirect, incidental, consequential, or punitive damages arising from use of our Services.
- Our total liability for any claim shall not exceed the fees paid to us by the claiming party in the 12 months preceding the claim.
- We do not guarantee job placement for any applicant or the availability of workers for any employer.
11. Indemnification
You agree to indemnify and hold harmless McGregor Sceptre LLC, its officers, employees, and agents from any claims, losses, or damages (including legal fees) arising from your breach of these Terms or misuse of our Services.
12. Termination
We may suspend or terminate your access to our Services at any time, with or without notice, for any reason including violation of these Terms. Upon termination, your right to use the Services ceases immediately, though provisions that by their nature should survive will remain in effect (e.g., limitation of liability, indemnification).
13. Dispute Resolution
- These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles.
- Any disputes shall first be addressed through good-faith negotiation.
- If negotiation fails, disputes shall be resolved through binding arbitration in Lubbock County, Texas, under the rules of the American Arbitration Association.
- Nothing in this section prevents either party from seeking injunctive relief in a court of competent jurisdiction.
14. Modifications
We reserve the right to modify these Terms at any time. Material changes will be communicated via email or a prominent notice on our website. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
15. Severability
If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.
